Apple discriminated against US citizens in hiring, DOJ says::Apple deterred US citizens from positions open to foreign workers, DOJ found.
And I am sure any costs Apple gets from this (legal costs and fines) will count for a small % of the profits they made from this practice.
“The cost of doing business”
I’m going to play the devil’s advocate here and point out that Green Card holders being chained to an employer is not Apple’s fault.
That’s a good point, our stupid federal policies are incentivizing this behavior from Apple. If they hire more Green Card holders, then they have employees that they can pay less, and they literally CAN’T quit for fear of deportation.
But Apple is also the richest company in the world and they employ enough lawyers to know that they’re not supposed to do this kind of shit, so I don’t really have sympathy for them in this case.
Green card is permanent residence, you’re confusing it with H1B Visa
Fair enough, I’m privileged enough to not know the details. But all the big companies do shit like that
H1B holders are chained to the employer (as are other visas), but green card holders are not. Source: green card holder.
This is the best summary I could come up with:
Apple illegally discriminated against US citizens and other US residents in its hiring and recruitment practices for certain types of positions that went to foreign workers, the US Department of Justice said yesterday.
The $25 million payment was called the largest ever collected by the Justice Department under the anti-discrimination provision of the Immigration and Nationality Act (INA).
“We have implemented a robust remediation plan to comply with the requirements of various government agencies as we continue to hire American workers and grow in the US,” Apple said.
As Reuters noted, “Foreign labor can often be cheaper than hiring US workers, and immigrants who rely on their employers for green card sponsorship are seen as less likely to leave for a different job.”
These less effective recruitment practices deterred protected workers from applying to positions that Apple preferred to fill instead with PERM beneficiaries."
Apple has already implemented some of the changes and agreed to “train its employees on the INA’s anti-discrimination requirements and be subject to departmental monitoring for the three-year period of the agreement,” the DOJ said.

Where does that 25 million dollars end up?
Generally, it goes to the US Treasury.
Every company discriminates. That’s what companies do. They only want the best and the brightest. Well, when the best and brightest only come from the most expensive schools and the most rich neighborhoods (meaning white men) how do you think that turns out? The problem is that we don’t lift up disadvantaged populations
They want the cheapest, not the best.
Sure whatever. Just saying no one should be surprised. Idk why this got such a strong reaction
Because it’s against the law?
Yes, it’s illegal. And it should be stopped. But my larger point is that it won’t stop by just making it illegal. Companies will continue to do this while it is in their best interest to do so
