A user is typically a natural person. A username identifies that person. Any information that is directly or indirectly linked to that username is thus personal data of that person. The GDPR explicitly gives “online identifier” as an example of an identifier. I did link to the official repository, which hosts translation in all European languages. Each translation can be reached with 1 click. It cannot be a language issue. I do not understand what the problem could be.

The personal data in the OP (consent options) are linked to a person via a cookie stored in their browser. I do not understand how one could make sense of the case without understanding what personal data is.

There also appears to be some confusion between GDPR and copyright. I do not know where these strange ideas come from.

Dem würde ich mich ja auch anschließen. Die Eltern haben halt das Recht darüber zu entscheiden? Ohne die Einwilligung aber eben nicht. Da geht nicht “was man will” da geht was erlaubt ist. Bei Meta waren die Einwilligungen nicht gültig, wegen Meta’s Monopolstellung. Dass die Anforderungen an die Einwilligung so hoch sind, ist direkt Datenschutz. Bei so sensiblen Daten, besonders von Minderjährigen, sind die Anforderungen dann noch mal höher.

Übrigens ist manche Datenverarbeitung auch mit Einwilligung verboten.

“Pay oder Okay” Modelle gibt es aber auch, und schon länger als bei Meta, anderswo im Netz. Speziell bei Nachrichtenseiten. Manche Leute werden dir erzählen, das sei bestimmt illegal. Keine Chance.

Nur weil es technisch Alternativen gibt (die aber nicht den selben Dienst bieten wie Facebook! Weil eben nicht die Leute da sind mit denen du dich eigentlich verbinden willst!) heißt das nicht, dass Facebook keine Macht über seinen Usern hätte.

Das ist ein Beispiel für “was man will, geht”. Ein Klassenfoto enthält hochsensible Informationen über die Kindheit. War das Kind gepflegt? Hinweise für Krankheiten? Und natürlich haben die Schulfreunde immer einen besonderen Platz im Herzen. Man kann die Namen ja über Gesichtserkennung rausfinden. Das Foto wird wahrscheinlich schon vom Fotografen bei der Bearbeitung in die Cloud geladen. Irgendwelche Eltern oder Großeltern stellen das dann digital bei Facebook oder sonst wo ein.

Das alles begründet außerdem nicht deine konische Meinung dazu, dass meta verurteilt wird und dass dann deiner Meinung nach zu unrecht.

Häh? Meta ist schon mehrmals mit Bußgeldern wegen Datenschutz belegt worden. Das ist Tatsache. Ich habe nie behauptet, das sei zu Unrecht. Übrigens sind solche falschen Behauptungen über Personen auch Datenschutzvergehen, aber in diesem werden wohl Ausnahmen greifen.

It helps to understand the GDPR if you think about data protection rights as a kind of intellectual property. In EU law, the right to data protection is regarded as a fundamental right of its own, separate from the right to privacy. The US doesn’t have anything like it.

Federation means that personal data is sent to anyone who spins up an instance. What legal basis is there for that? These guys and their lawyers weren’t able to figure one out.
