No, that’s not how that works. Agencies can not bind future policy. If that was the case, a Democratic President could just come in and have an agreement that all Republican ideas are bad and then every Republican President would be bound to that.
Even legal settlements don’t bind policy.
Also, this would be easy to overturn when a new DoJ comes in because it literally violates “Self-Dealing” which ends the validity of a settlement.
But we all know the next President and DoJ aren’t going to bother with this. But nothing said today is legally binding “forever”. The second Trump is no longer President none of this agreement matters, unless the next President is as chicken shit as what we saw during Biden’s term and the whole Garland thing.
If someone with balls becomes President all of this is undone, except all that money he put into the fund and will likely drain out will be hard to recover, like requiring multiple Presidents terms to claw back.
